In May, Convocation amended By-Law 11 — Regulation of Conduct, Capacity and Professional Competence. Law Society staff are permitted to withdraw an application in its entirety without approval from PAC, before a hearing on the merits has begun.
Convocation confirmed that staff do not need approval from the Proceedings Authorization Committee (PAC) of the Law Society to withdraw or amend particulars in an application before the Hearing Panel.
The Professional Regulation Committee recommended the change in a May 30 report.
That report includes data on the first quarter of 2013, which indicates 1,287 new complaints were made in that period — a slight increase over the first three months of 2012. Four hundred new cases came to the Investigation Division in the first quarter of 2013 — 32% more than in the same period in 2012.
Unauthorized practice complaints are down over the first quarter of 2013, for both non-licensees and reports of licensees providing services that are outside the authorized scope of practice. Permanent injunctions are being sought in two matters.
