Newmarket Company, Director Fined Over Unpaid Wages

Ignoring an order to pay wages to 12 employees cost a Newmarket painting company and its director $90,000 in fines, in addition to $33,000 in wages owed.

Com-Kote Interiors Inc. and director Frank Abbaglivo had pleaded guilty in January. The sentence was delivered June 25. Com-Kote was fined $60,000 — $5,000 per count — for failing to comply with an order to pay wages. Abbaglivo was fined $30,000 for failing to comply with a director’s order; the company was again ordered to pay $33,000 in wages.

Com-Kote and Abbaglivo each has 24 months to pay the fines.

The Employment Standards Act, 2000, prosecution under the Provincial Offences Act took place in Newmarket, before Justice of the Peace Chantal Dube.

As required by the Provincial Offences Act, a 25-per-cent victim fine surcharge applies.

    It is a pity that these types of decisions are not placed in the community’s newspapers for all the “neighbours” to see. These workers have not been paid since 2008… absolutely despicable!
